Guess Who's Suing A Tabloid This Time?

DAVID DUCHOVNY has followed through on his threat to sue Britain’s Daily Mail over an article which alleged he was dating his tennis coach.

The actor, who recently announced his marriage split from Tea Leoni, has filed a lawsuit against the newspaper claiming he was defamed by what editors published.

The Daily Mail reported that Duchovny had a "full-blown sexual affair" with Edit Pakay, 28 - a story the tennis coach has since denied.

In the lawsuit, filed on Wednesday (22Oct08) in Los Angeles County Superior Court, Duchovny’s lawyer states, "The story falsely alleges that Duchovny sought out Ms. Pakay to be his tennis instructor and that the ‘professional relationship’… quickly turned into a love match." The suit also points out the newspaper claimed Duchovny had said he would leave Tea Leoni for Pakay.

Duchovny insists there was never a romantic relationship. The suit claims, contrary to the story, that Pakay never told the paper there was a romantic or sexual relationship.

According to TMZ.com, the actor wants at least $1 million (£625,000) in damages.

The X Files star allegedly agreed to seek treatment after heartbroken Tea Leoni discovered his indiscretions and threatened to divorce him.

‘He said Tea gave him an ultimatum: Get treatment or our marriage is over,’ a source is quoted as telling the National Enquirer.

‘She felt it was ruining their marriage and affecting their kids.’

The actor has been married to the Deep Impact actress for 11 years, and the couple have a daughter, Madelaine West, nine, and a six-year-old son, Kyd.

According to the source, Duchovny has admitted that he is compulsively driven to be unfaithful and finds it impossible to turn down the legions of women who offer themselves to him.

Leoni is said to have grown suspicious of her husband’s behaviour in recent months and after questioning him on a number of occasions, the 48-year-old finally admitted that he had been cheating on her.

Duchovny checked into The Meadows facility in Arizona last week and is currently completing a 35 day course. His wife has been to visit him at the centre several times.

"I have voluntarily entered a facility for the treatment of sex addiction," the actor says in an exclusive statement. "I ask for respect and privacy for my wife and children as we deal with this situation as a family."

The 46-year-old actor, who played Agent Mulder on the cult TV show for nine years, revealed he and co-star Gillian Anderson are ready to reprise their roles for a second film.

He told movie website IESB.net: 'We'll do another movie or two, we'll continue to do movies if the next one does well.' David says the writers are currently busy brainstorming details for the new script.

He said: 'There is a board, as we say, a story. The story will revolve around Gillian's character, Dana Scully, and my character, Fox Mulder.' The first film - 'The X Files' - was released in 1998 and a sequel has always been promised.

Dates for filming or release are yet to be confirmed.
