It’s been over a year since the deaths of Anna Nicole Smith and her son, Daniel, but somehow the family remains in the news. This time, Larry Birkhead testified in the Bahamas during the inquest involving Daniel’s sudden death in September 2006.

Birkhead testified that in April 2006, Anna realized some of her Methadone was missing in her Studio City home. Birkhead said Anna had surveillance cameras in the house, checked them and found video proof that Daniel and his buddies were the culprits.

While Birkhead was under oath, he was asked about statements he made to the cops back in 2006, when he was at war with Anna. He had told police he saw Howard K. Stern smoke pot with Anna and Daniel. During his testimony, Birkhead said he was not completely clear on what he saw.

Birkhead said Daniel’s personality completely changed between January 2006 and May. He saw Daniel throw a TV through a window. Daniel often stayed out all night long and Anna was worried.

Larry then went on to pose with baby Danielynn on the witness stand and sold the pictures to OK! magazine.

Dannielynn Hope Could Be Very Rich

A petition to have Anna Nicole Smith's 18-month-old daughter declared the sole heir to her estate was approved today by a Los Angeles judge.

In court papers filed last Oct. 18 in Los Angeles Superior Court, Howard K. Stern, the executor of Smith's estate, sought to clarify Smith's intentions in her July 2001 will, drafted five years before Dannielynn Hope's September 2006 birth.

"We and Mr. Stern always believed that Anna Nicole never intended to disinherit her daughter," Stern's lawyer, Bruce S. Ross, said after the hearing. "I'm pleased to say this chapter in the saga is closed."

Judge Mitchell L. Beckloff's ruling not only confirms Dannielynn Hope as her mother's sole heir, but also establishes a trust on her behalf with Stern and the toddler's father, photographer Larry Birkhead, as co-trustees, Ross said.

Dannielynn, who is being raised by Birkhead, could inherit millions of dollars from the estate of Smith's second husband. Billionaire J. Howard Marshall left much of his fortune to Smith in his will, although his family has contested it.

Ross said today's action will have no bearing on Dannielynn's possible inheritance of the Marshall fortune, which is tied up in litigation in the 9th U.S. Circuit Court of Appeals.

Larry Birkhead Is A 'Mo?

Anna Nicole Smith's former bodyguard, Big Moe said that Larry was chosen by Anna because he was pretty and that he was nothing more than a sperm donor. Ouch!!!

Big Moe told Access Hollywood, "Anybody that's been around Anna, they would know that Larry wouldn't be her type. First of all, she liked men that was wealthy, I mean that's no secret."

Big Moe said, "Well, she told me that, you know, he was a homosexual. She knew deep down that he didn't want to be with her."

Big Moe was also upset that Larry is using Dannielynn Hope to make money especially about the part where he was having his picture taken at Anna's gravesite.

"I thought that was very disgusting, I thought it was staged. I do believe he loves his daughter, but the thing is, when he comes on TV and he parades her off, it seems like it's like a laugh in Anna's face. Like, 'Ha! I got her anyway!’"

Rita Cosby Is Fishy

A judge has ruled that there's a lot of evidence that former MSNBC anchor turned author Rita Cosby crossed the line in writing her tell-all book about Anna Nicole Smith.

Howard K. Stern is suing Cosby, claiming she defamed him in the book by saying there are witnesses -- two nannies -- who say Anna Nicole had a video of Stern and Larry Birkhead having sex.

A federal judge in the Southern District of New York issued an order today in the wake of Stern's allegation that Cosby "sought to tamper with two witnesses by offering to pay them thousands of dollars for their testimony." The judge allowed Stern to probe the allegation, concluding he has "presented substantial -- indeed troubling -- evidence that Cosby has sought to improperly influence witnesses..."

In a statement to TMZ, Rita Cosby said "I am pleased that the Court will get to the bottom of these unfounded allegations. I trust that when all the facts come out that a very different picture will be shown."

Anna Nicole Smith Saga Continues - beyond The Grave

The attorney who represented Anna Nicole Smith's infant daughter in the rancorous dispute over the starlet's body is seeking nearly $200,000 for his work.

Richard Milstein served as the court-appointed guardian ad litem for Dannielynn Hope Marshall Birkhead. He has filed paperwork in state court in Broward County seeking $198,493.98 from a trust set up in Dannielynn's name.

Attorneys for the girl's father, Larry Birkhead, and Smith's longtime companion, Howard K. Stern, say Milstein's bill would exhaust nearly the entirety of an estimated $200,000 remaining in the trust, though the girl could eventually inherit millions more.

Besides acting as Dannielynn's representative in a Fort Lauderdale court, Milstein also helped coordinate funeral arrangements for Smith.

"This representation required the guardian ad litem to devote significantly all of his professional and personal time and attention to the interests of Dannielynn for a period in excess of two weeks," Milstein argued in his petition.

He did not return a phone call Monday seeking additional comment.

The matter is scheduled for a hearing Nov. 8, but attorneys for Birkhead, Stern and Smith's mother have already opposed.

"It is unconscionable for a trust established for a baby to be billed at a large firm hourly rate," wrote attorneys for Birkhead and Stern. They also said the Playboy model's mother, Virgie Arthur, should pay at least part of the bill, which the mother's attorney called ridiculous.

Lawyer Stephen Tunstall did find common ground with Birkhead and Stern in his objection to Milstein's accounting. He said the guardian ad litem "went wild" in generating a bill.

Smith, who died Feb. 8 in a Hollywood hotel, was the widow of Texas oil tycoon J. Howard Marshall II. She had been fighting Marshall's family for years over his estimated $500 million fortune, which could eventually go to Dannielynn.

A source says the father of the late Anna Nicole Smith's daughter, Dannielynn, who's been inundated with offers ever since bringing the baby home, has an agreement in principle with one television producer.

"I don't want to give away something yet," Birkhead told us yesterday. "It's basically the 'day in the life of daddy duties.'

"The truth is, people came to me with pitches, and I haven't accepted anything. It's something they continue to talk to me about. It's multiple networks. I'm listening to what they have to say. I turned down ["Celebrity Rap Superstar"].

We asked Birkhead, a professional photographer, whether reports were true that he is keeping all $1.7 million from OK! magazine for exclusive pictures of him and the infant, instead of putting some in an
account for her as stipulated in the mag's deal.

"I'm not going to discuss contracts because of confidentiality agreements," Birkhead told us. "And I don't think it's anyone's business. But if I wanted to, I can do whatever I want to, because she's my daughter.

"Let Anna rest in peace, and let me move on."

Has Birkhead moved on? He was recently pictured with a mystery brunette. "I'm not dating anyone," he said. "The 'gal pal' is just a pal. She's just my assistant, Lisa.

"My daughter is my focus now. I'm being a great dad. She's teething. She's got about eight teeth. Everything is great with her. She chomps on me every day. All she has to worry about is her Barney video."

"The Insider" breaks news that author Rita Cosby has been served with a complaint for libel by Howard K. Stern, for alleging an affair between Stern and Larry Birkhead -- the father of Anna Nicole Smith's baby, Dannielynn -- in her book Blonde Ambition: The Untold Story Behind Anna Nicole Smith's Death.

Cosby was served with the papers at her book party, and Anna's mom, Virgie Arthur was present at the time.

Anna Nicole Smith’s lawyer and companion, Howard K. Stern, filed a $60 million libel lawsuit Tuesday against Rita Cosby and her publisher over a book she wrote that claims Stern and Smith’s ex-boyfriend, Larry Birkhead, had a sexual encounter.
The suit, filed in federal court in New York, seeks $10 million in compensatory damages and $50 million in punitive damages from Cosby — who wrote “Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death“-- and Hachette Book Group USA Inc.

The book, which hit stores in September, claims that besides the alleged sexual encounter, Birkhead and Stern both worked together after Smith’s death to manipulate the media and maximize profits.

The suit says that the book falsely accuses Stern of, among other things, criminal lewd acts, homosexual acts, illegal possession and use of cocaine, conspiring to commit murder and kidnapping for ransom.

“Defendants have exploited Ms. Smith’s life and death by publishing false and defamatory factual accusations against” Stern, according to the 65-page lawsuit filed by Atlanta lawyer Lin Wood.

A spokesman for Cosby declined to comment and referred calls to a spokesman for the book’s publisher. That spokesman, Evan Boorstyn, did not immediately return a call Tuesday seeking comment.

Both Birkhead, the father of Smith’s infant daughter, and Stern, Smith’s longtime attorney and companion, had threatened to sue soon after the book was published. Tuesday’s lawsuit only lists Stern as a plaintiff.

An attorney for Birkhead, M.L. Trope, did not immediately return a call to his Los Angeles office Tuesday seeking comment.

Birkhead acknowledged meeting with Cosby several times after Smith’s death in February. But he flatly denied that he and Stern ever shared a sexual tryst.

Cosby, a former MSNBC correspondent, claimed there is a videotape of the alleged encounter and that one of Smith’s former employees had seen the former Playboy Playmate watching it. But Birkhead has said no tape could exist because the encounter did not occur.

Birkhead also has denied the book’s claim that he and Stern made a “secret deal” about finances and the custody of Smith’s daughter, Dannielynn.

Cosby has said she expected backlash from Birkhead and Stern when she started writing the book in April.

Debra Opri is pissed that Larry B appeared on Larry King's show and claimed that he witnessed Opri give Rita Cosby confidential documents in his custody battle not to long ago but Opri's lawyer say that this is false and defamatory and is giving Larry B an opportunity to retract.

Now, Michael Trope, Larry B's lawyer says that this will not happen>

"Mr Birhead declines your invitation to issue any type of retraction".

I guess Trope is a funny guy considering he ended the letter with this:

"Larry would like her to avoid the expense of hiring a process server to deliver the complaint. I have Mr. Birkhead's authority to accept service."

Anna Nicole Smith's ex boyfriend and jailbird, Mark Hatten is claiming that Howard K. Stern tried to kill him back in 2000, in a failed "attempt to remove" him from Anna's life.

In the lawsuit obtained by TMZ, Hatten claims that Howard tried his very best to try and murder plaintiff Hatten and make it look like an accident death/overdose."

Hatten wants $100,000,000 in damages.....

I guess Ana Nicole Smith is glad that she's dead now.

Howard K Stern's Toy Boy Will Sue

Larry Birkhead told AP that he is intending to sue Rita Cosby over her "salacious" book pegging that he was having an affair with Howard K. Stern. Ewwww..... sorry the thoughts of Larry on his knees infront of Howard is pretty gross.... so anyways, not only will he being suing Rita but he will also go after her sources and Grand Central Publishing.

He told TMZ's Harvey Levin last night on CNN's Larry King Live" that is "pure fiction" is "totally false and defamatory." He also said that Rita never once contacted him or Howard to see if any of these things are true. He also said that this is going to be "one of the most expensive lawsuit settlement in book publishing history."

A new tell-all about Anna Nicole Smith from former MSNBC journalist Rita Cosby about alleges that Howard K. Stern and Larry Birkhead were secret gay lovers.

The book, "Blonde Ambition: The Untold Story Behind Anna Nicole Smith's Death" describes an alleged brief tryst between Stern and Birkhead, reports the Daily News. Jackie Hatten, described as a friend of Anna Nicole's, claims she found Stern and Birkhead witht heir shirts off and pants around their ankles, engaged in oral sex.

The book also accuses the feuding baby daddies of cutting a secret deal between them in which Birkhead would get custody of Dannielynn in return for Stern being named executor of Anna Nicoles estate.

Both Birkhead and Stern deny all of Cosby's accusations. Birkhead said that he was disgusted by Cosby's claims that he and Stern were gay lovers. "If she printed that then she is really getting sued," he said.

Stern's lawyer Lin Wood called the book "false and defamatory."

OK! magazine just pulled the plug on its first birthday photo shoot with Dannielynn Birkhead and her daddy Larry. OK! issued a statement saying it has moral issues pushing Birkhead, because the mag has uncovered "shocking and potentially incriminating" info. But Larry B tells TMZ it's a smear campaign.

Birkhead says OK! was bent out of shape after Us Weekly put Dannielynn on its cover. Birkhead, who made a sweet exclusive $1.7 million deal with OK!, claims the OK! reporter threatened to do a nasty story on Larry if he dealt with a competing mag.

Birkhead, who says he didn't play ball with Us, wrote an email to OK! in which he said, "I was just threatened via email by (the reporter) that OK! would do a negative story on me if I did any stories with any other mags. Ridiculous!!! I am not sure what planet she's on but I am not going to be threatened. She blew it!"

OK! sources say no way did their reporter "threaten" Birkhead. These sources say they had "an exclusive four-part deal" with Larry -- while Birkhead says the deal was for the first photos of Dannielynn and that's it. OK! flipped when they saw Larry and baby on the Us cover, and began seeing him pop up on competing outlets.

In another email obtained by TMZ, OK! Editor-in-Chief Sarah Ivens doesn't hide her displeasure, saying, "You know how well we've treated you ... from free suits to getting a singer for your party ... to be honest, we are upset that you've turned on us." Larry, for his part, says he didn't double deal.

Tot Dannielynn Birkhead is set to party with 200 guests at party hostess Tricia Barnstable Brown’s Louisville, Kentucky mansion on 8 September (07) one day after her birthday.

And the child is delighted with the choice of theme at the bash organised by her dad, photographer Larry Birkhead.

Dawson Bullock, the invitation designer, says, "Larry knew he wanted a princess theme from the start.

"He chose a tiara and wand invitation, and the front reads ‘Princess Dannielynn.’ When we first showed little Dannielynn the invitation, her whole face lit up! She is absolutely adorable!"

The former boyfriend of the late ANNA NICOLE and the father of her baby came out to the big Hollywood premiere of 'The Bourne Ultimatum' Wednesday night with his nephew, and said that the requirements of being a new dad are almost the same as being a super spy.

"If MATT DAMON drops out of the next movie, maybe I'll be available," he jokes. "I've been punched and kicked and slapped by my daughter, so I'm in defense mode. She's using me as a teething ring."

But there was one hitch on the way to the red carpet: "She actually spit up on my jacket I was going to wear, so I had to take it off and do a quick change."

Dannielynn is going to have her first birthday in September, and Larry says he's weighing his options for the special day.

"I'm thinking big," he says. "Her mom called her princess, so [I'm thinking of doing] something kind of Disney princess, or Hello Kitty -- something real cool, so she can look back on it and say, 'What a cool party.'"

As for any ladies in his life, Larry says there's only one girl for him right now.

"The only lady in my life is my daughter, and she takes all my time, and that's all I need right now -- making up for lost time," he says. "We're just having fun together and hanging out."

ANNA NICOLE SMITH’s ex-boyfriend LARRY BIRKHEAD has accused his former attorney DEBRA OPRI of making unsecure loans totalling $200,000 (£100,000) to a criminal.

The claims form part of a lawsuit Birkhead has filed against his former lawyer for allegedly defrauding him out of hundreds of thousands of dollars. He also claims Opri promised to represent him free of charge in his custody battle for Anna Nicole Smith’s daughter earlier this year (07).

But Opri argues Birkhead refused to pay $650,000 (£325,000) in legal fees following the court case.

In court papers filed on Tuesday (03Jul07), Birkhead further claims Opri gave approximately $200,000 to John Wu and according to the report, "Mr. Wu had never repaid any portion of the $200,000, yet she had continued to loan him money on four or five occasions over the years because of their close friendship." TMZ reports John Wu recently pleaded guilty to federal charges of conspiracy to import missile systems designed to destroy aircraft.

But Opri has submitted a declaration from bodyguard Mark Speer, who alleges he heard Larry discuss billing with Opri. Speer says Birkhead was totally aware that his $1million (£500,000) fee from a TV interview was going to be deposited in Opri’s client trust account. According to Speer, "Larry clearly understood that this money was going to pay some or all of his current legal bills relating to his case with Debra." Birkhead is seeking a minimum of $885,000 (£442,500) in damages and further punitive damages and rescission of any fee agreements he claims to have signed under fraudulent pretences.

Larry Birkhead To Go Nude?

If it was up to Playgirl Magazine, they would love to take pictures of Larry Birkhead naked. They're even willing to pay him $100,000 for it.

Apparently, he's too chicken to do it.

He tells In Touch Weekly magazine, "I'm too chicken to take my shirt off most of the time, much less my pants!"

Larry Birkhead, 34, filed a petition in probate court on Monday to be appointed as the sole guardian of the Estate of 8 month-old Dannielynn Marshall Birkhead. In papers obtained by Us, Birkhead asks the court to name him as guardian "in order to represent his daughter's interest in the probate proceedings for the Estate of Vickie Lynn Marshall, aka Anna Nicole Smith." Birkhead's hearing is set for June 19.

Meanwhile, according to Smith's will, Howard Stern has been named special administrator as well as executor of her estate. Smith's personal attorney Ron Rale was named second executor.

The will, which Smith signed and dated on July 30th, 2001, before Dannielynn's birth and son Daniel's death, lists her sole child as Daniel Wayne Smith. The will directs that all of Smith's property, after the payment of taxes, be distributed to Howard Stern, who will hold it in a trust for her child, Daniel. Once the child reaches 25, the will provides they will be given one third all the income and one half the principal of the trust. At age 35, her child will be given all the remaining principal of the trust. It states that Smith's spouse is deceased and has no registered domestic partner. Smith's estate's current estimated value is listed as $710,000.

Birkhead, who arrived in the states with Dannielynn on May 1st, should prepare for a challenge to his request for guardianship: Anna Nicole Smith's mother, Virgie Arthur, has promised she will continue to fight for custody of her granddaughter.

After Smith’s death on February 8, Birkhead, Howard K. Stern and Prince Frederick Von Anhalt all came forward with claims that they were Dannielynn’s real father. Birkhead was awarded custody of the baby when the Bahamas Supreme Court resolved the matter with a DNA test.

The new face of evil, Vergie Arthur, has been fined $3,000 in attorney's fees for wasting the court's time with a "weak" appeal.

The Bahamian judge was so grossed out with this grandmother from hell that he told her to get in touch with Heather Mills and Kevin Federline for some tips on how to rip off people.... okay kidding here.

Anyways, Larry Birkhead is now free to comeback to the US with his daughter..... hope I'm invited to his "coming home party" for Dannielynn.
